This Privacy Policy covers Health Hero's treatment of personal
information that Health Hero gathers when you are on the Health Hero
website, www.GoHealthHero.com (the "Site"), when you use Health Hero
services and how that information is shared with other parties, with
regard to the information we collect through the Health Hero Rewards
Program (the "Rewards Program") and any of our Marketing Programs
(collectively with the Rewards Programs, the "Programs"). We reserve
the right to modify this policy at any time, and without prior notice,
by posting amended privacy policy and terms on this website. We
encourage you to review this policy periodically for any updates.
The Site is owned and operated by Breadly, LLC.
Note: Corporate users can only be eligible for gift card rewards based
on their monthly goal achievement.
How Personal Information Is Used
In order to improve the quality of results as you use Health Hero
repeatedly, Health Hero may use a temporary session cookie to remember
how you use Health Hero. This temporary history is not stored on your
computer nor is it tied to personally identifiable information.
Certain other functions of Health Hero create profile data ("Profile
Data") and are only available if you create and are logged in to a
Health Hero account:
We ask for your email address and a password when you create your
account in order to control access to it. Your username is used to
identify you to other Health Hero users if you specifically allow for
this to happen.
By default when you are logged in, Health Hero remembers how you use
Health Hero. Over time this will increase the effectiveness of the
services you receive.
Health Hero may make certain aggregated and anonymized data available
to developers via an Application Programming Interface ("API"). Data
accessed from the API may be used in outside applications subject to
the review and approval by Health Hero.
Health Hero may collect and display on Health Hero statistics about
your usage of the Health Hero service and associate this data with
your username.
Health Hero may periodically ask you to complete short surveys about
your experiences (including questions about products and services) for
research purposes and/or on behalf of third parties with which Health
Hero works closely ("Partners"). You are free to respond or not. Your
participation in these surveys is not required, and your refusal to do
so will not impact your experience on the site.
To keep you informed of the latest improvements and alerts relating to
Health Hero, Health Hero may send you emails and or mobile alerts. You
have the ability to opt out of receiving emails and/or mobile alerts.
Sharing of Personal Information
Any personal information that you voluntarily disclose on public areas
of Health Hero becomes publicly available and could be collected and
used by other people. We strongly discourage you from providing any
sensitive or personally identifiable information (such as an email
address or phone number) through free text or images (e.g., photos,
bios, forum postings, evaluations) when submitting or contributing to
such public content. As with most internet communities, Health Hero is
a public forum and you acknowledge and accept that any information you
share is connected to the Profile Data above.
We may also use your email address without further consent for
infrequent, important marketing or administrative purposes. Health
Hero reserves the right to send specific administrative notices that
are required by law, regulation, or as needed to service your account,
even if you have opted out of receiving marketing messages.
Health Hero reserves the right to send specific notices about your
program activity if you have engaged with specific programs, tools or
applications from Health Hero (e.g., Point earning, Badges, alerts).
We may share with third parties certain pieces of aggregated,
non-personal information such as usage statistics and effectiveness
metrics. Such information does not identify you individually.
Health Hero or Partners may send you marketing messages about
products, special offers and services offered by Health Hero or third
parties. If you do not wish to receive specific program notices or
marketing messages, you may opt out by updating your account profile
at any time at the Site or by contacting Health Hero's customer
service department at hello@gohealthhero.com
We may employ other companies and people to perform tasks on our
behalf and sometimes need to share your information with them to
provide products or services to you. Examples include analyzing data,
providing marketing assistance, and providing customer service.
The Site and emails we send you may contain links to other websites.
We are not responsible for the content or privacy practices of those
websites, including the use of personally identifiable information
about Health Hero members collected by those websites.
Other members, and sometimes Partners (pursuant to written agreements
designed to limit the use and disclosure of your personally
identifiable information), will be able to view your Profile Data.
Additionally, so that others can learn from your experiences, your
Profile Data will be aggregated and made available to other members
and non-members.
In some cases, we may choose to buy or sell assets. In these types of
transactions, customer information is typically one of the business
assets that is transferred. Moreover, if Health Hero, or substantially
all of its assets, were acquired, customer information would be one of
the assets that is transferred.
Additionally, we may disclose your personal information after
notifying you and obtaining your consent.
Information Collected
Health Hero uses both personal and non-personal information to provide
you with a superior user experience and, as necessary, to administer
our business. For example, we collect information that allows us to:
· Reward participants in the Rewards Program for certain activities;
· Be able to reward participants in our Marketing Programs;
· Provide a more personalized experience;
· Authenticate a user's identity;
· Promote partners and vendors who support Health Hero's Programs;
· Conduct research and perform analysis in order to measure,
maintain, protect, develop, and improve services;
· Administer sweepstakes, contests, promotions, or surveys;
· Communicate with you about special offers, events, or new
products or services;
· Customize and enhance our Site and advertising.
To participate in any of our Programs we may need to know your home
address or contact address, contact phone number, email address, which
we receive through various sources including a Health Hero Marketing
Partner or yourself through voluntary sign-up. In order to participate
in any of our Programs, we also may require you to create a unique
password and security PIN and question and to agree that Health Hero
may record certain information about you. From time to time,
participants will be asked for personally identifiable information
such as demographics (age, income, etc), psychographics (what you like
to purchase, etc) and interests. Submission of this information is
entirely voluntary and may qualify you for additional rewards and
Health Hero Points earning opportunities. In addition, Health Hero
records content, such as text, images, pictures, and profile
information, which you may either submit or upload to the Site or
other Health Hero platforms such as off-site mobile applications or a
social media platform. User images and screen names that you upload to
the Site or select will be displayed in order to identify you, both to
yourself and to other participants.
To best serve you, we may combine this information with data that is
publicly available and data that we receive from other reputable
sources whose policies meet the Direct Marketing Association's privacy
standards.
Before you begin participation in any of our Programs, you will need
to activate or register your account on either the Site or via a
Health Hero partner site. The method for activating or registering
your account will vary by Rewards Program.
Health Hero does not rent or sell members' personally identifiable
information or program activity with anyone without a member's
expressed consent.
If you choose to send Health Hero email inquiries or feedback or
contact the customer service department, Health Hero may collect your
personal information including your email address.
We reserve the right to report to law enforcement agencies any
activities that we, in good faith, believe to be unlawful.
Automatically Collected Information
When you use Health Hero, our servers automatically record standard
information that your browser sends whenever you visit a website.
These server logs may include information such as the page(s) you
visited, your Internet Protocol address, Health Hero cookie
information, browser type, browser language, and the date and time of
your request. Health Hero uses this traffic data to help diagnose
problems with its servers, analyze trends and administer Health Hero.
Generally, Health Hero automatically collects usage information, such
as the numbers and frequency of visitors to Health Hero and its
components, number of links clicked within the Site, etc. This data is
only used in the aggregate. This type of collective data enables us to
determine how users interact with the Health Hero service, so we can
identify areas for improvement.
We use cookies to make Health Hero easier for you to use, for example
by remembering that you are logged in. Cookies are alphanumeric
identifiers that we transfer to your computer's hard drive through
your web browser to enable our systems to recognize your browser and
tell us how and when pages in Health Hero are visited and by how many
people. Health Hero cookies do not collect personal information, and
we do not combine information collected through cookies with other
personal information to tell us who you are or what your screen name
or email address is.
The "help" portion of the toolbar on the majority of browsers will
direct you on how to prevent your browser from accepting new cookies,
how to command the browser to tell you when you receive a new cookie,
or how to fully disable cookies. You can set your browser to refuse
all cookies, but some Health Hero features and services may not
function properly if your cookies are disabled. We strongly recommend
that you leave the cookies activated, however, because cookies enable
you to take advantage of some of Health Hero' most attractive
features.
Reviewing, Updating or Deleting Your Personal Information
You can visit your membership profile page and amend your Profile Data
at any time to:
Update or correct your personal profile information or preferences
Delete your account completely
Confidentiality and Security
Your Health Hero account information is protected by a password for
your privacy and security. You need to work to protect against
unauthorized access to your password and to your computer by signing
off once you have finished using a shared computer.
Only employees or agents who need personal information to perform a
specific job (for example, a customer service representative) are
granted access to it. All of our employees and agents are kept up to
date on our privacy and security practices and Health Hero takes
commercially reasonable technical precautions to help keep your data
secure. All of our employees and agents are required to sign
confidentiality agreements that require that they keep such personal
information confidential.
Though we make every effort to preserve your privacy, we may need to
disclose personal information when required by law or if we have a
good-faith belief that such action is necessary to comply with a
current judicial proceeding, a court order or legal process. We may
also disclose personal information under certain limited circumstances
if we feel it is necessary to enforce or apply our Terms of Service or
other agreements; or protect the rights, property, or safety of Health
Hero, our employees, our users, or others.
Health Hero cannot guarantee the identity of any other members with
whom you may interact in the course of using the Site or who may have
access (based on the privacy level you have selected) to information
you have posted. Additionally, we cannot guarantee the authenticity of
any data that members may provide about themselves.
Health Hero provides links to and information relating to many other
websites, including websites with whom we may have a business
relationship. We do not exercise control over those websites, and each
has its own privacy policy that is distinct from this one. These other
websites may also place their own cookies or other files on your
computer, collect data or solicit personal information from you.
Services Are Provided As-is and Without Any Warranty
Health Hero has no special relationship with or fiduciary duty to You;
Your access to and use of the Services or any Content is at Your own
risk. You understand and agree that the Services is provided to You on
an “as is” and “as available” basis.
We will use reasonable efforts to ensure that the Services are
available at all times. However, there will be occasions when the
Services will be interrupted for maintenance, upgrades and repairs or
due to failure of telecommunications links and equipment. We will take
reasonable steps to to minimize such disruptions within Our reasonable
control. We make no warranty that the Services will meet Your
requirements or be available on an uninterrupted, secure, or
error-free basis.
Although We will make reasonable efforts to store and preserve the
material residing on the Services, We are not responsible or liable in
any way for the failure to store, preserve or access Your Content. You
are strongly urged to take measures to preserve copies of any Content
You post or upload on the Services.
Health Hero will not be responsible or liable for any harm to Your
computer system, loss of data, or other harm that results from Your
access to or use of the Services, or any Content. You also agree that
Health Hero has no responsibility or liability for the deletion of, or
the failure to store or to transmit, any Content and other
communications maintained by the Services.
Health Hero will not be liable for the privacy of email addresses,
registration and identification information, communications, or any
other Content stored on the Services or otherwise connected with Your
use of the Services.
Without limiting the foregoing, Health Hero expressly disclaims all
warranties of any kind, whether express or implied, including, but not
limited to the implied warranties of merchantability, fitness for a
particular purpose and non-infringement. We further make no warranty
and disclaim all responsibility and liability for the completeness,
accuracy, availability, timeliness, security or reliability of the
Services or any content thereon. No advice or information, whether
oral or written, obtained from Health Hero or through the Services,
will create any warranty not expressly made herein.
Children
Health Hero should not be used by individuals under thirteen years of
age. We do not intend to collect any personally identifiable
information from such individuals.
Your Acceptance of These Terms
By using Health Hero, you signify your assent to this Privacy Policy.
If you do not agree with this Privacy Policy, please do not use Health
Hero and cease participation in the Programs. Your continued use of
Health Hero following the posting of changes to these terms will mean
you accept those changes.
By agreeing to participate in the Rewards Program, one of our
Marketing Programs, or accessing the Site, you acknowledge and fully
understand this Privacy Policy, agree to be bound by the terms
contained in this Privacy Policy and freely consent to the information
collection and use practices described herein.
Services Are Provided As-is and Without Any Warranty
Health Hero has no special relationship with or fiduciary duty to You;
Your access to and use of the Services or any Content is at Your own

Waiver
Wellness Program Waiver RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF
RISK, AND INDEMNITY AGREEMENT ("AGREEMENT") FOR AND IN CONSIDERATION
of being permitted to voluntarily participate in the “Health Hero
Program”, for myself, my personal representatives, assigns, heirs, and
next of kin: ACKNOWLEDGE, agree, and represent that my participation
in the “Health Hero Program” is voluntary and is not an expressly or
impliedly required incident of my employment. I further understand,
agree, and acknowledge that the “Health Hero Program” will not produce
any substantial direct benefit to Health Hero beyond improvement to
employee health and morale that is common to all kinds of recreation
and social life. ACKNOWLEDGE, agree, and represent that I understand
the nature of the “Health Hero Program” and that I am qualified, in
good health, and in proper physical condition to participate. I
further agree and warrant that if at any time I believe conditions to
be unsafe, I will immediately discontinue further participation in the
“Health Hero Program.” FULLY UNDERSTAND that: (a) the “Health Hero
Program” involves risks and dangers of serious bodily injury,
including permanent disability, paralysis, and death (“Risks”); (b)
these Risks and dangers may be caused by my own actions or inactions,
the actions or inactions of others participating in the “Health Hero
Program”, the condition in which the “Health Hero Program” takes
place, or the negligence of the “Releasees” named below; and (c) there
may be other risks and social and economic losses either not known to
me or not readily foreseeable at this time; and I fully accept and
assume all such risks and all responsibility for losses, costs, and
damages I incur as a result of my participation the “Health Hero
Program.” HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Health
Hero and any of its past, present, or future parent corporations,
subsidiaries, divisions, affiliates, successors and assigns and its
and their officers, directors, agents, trustees, insurers, attorneys,
employees, administrators, members, volunteers, and other participants
(collectively referred to as “Releasees”) from all liability, claims,
demands, losses or damages on my account caused or alleged to be
caused in whole or in part by the negligence of the Releasees or
otherwise, including negligent rescue operations; and I further agree
that if, despite this Release and Waiver of Liability, Assumption of
Risk, and Indemnity Agreement I, or anyone on my behalf, makes a claim
against any of the Releasees, I will indemnify, save and hold harmless
each of the Releasees from any litigation expenses, attorneys’ fees
and costs, loss, liability, damage, or cost which may incur as the
result of such claim. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS
TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING
IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF
ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF
ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF
ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE,
NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
Changes to this Privacy Policy
We may update this policy at any time by simply posting such addition
or modification on Health Hero. If at any point we decide to use
personally identifiable information in a manner materially different
from that stated at the time it was collected, we will notify users by
way of an email or via a prominent notice on our website.
